1. Acceptance of Terms
These Terms and Conditions ("Terms") are a binding agreement between you and Bookmecheapest LLC, doing business as BargainAirTicket ("BargainAirTicket," "we," "us," or "our"), governing your use of our website, phone booking services, and any related communications (collectively, the "Services").
By visiting our website, calling our booking desk, submitting a call-back request, messaging us or our partners, or otherwise using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services. If you are using the Services on behalf of another person (for example, booking travel for a family member), you confirm you have their authority to accept these Terms on their behalf.
2. Who We Are & What We Do
BargainAirTicket is an independent travel marketplace and agency. We help customers find, compare, and book flights, hotels, car rentals, cruises, and train travel β primarily through phone-based consultations, supplemented by wholesale and consolidator fare access not always available through public search engines.
We operate our own in-house booking center that takes inbound calls and makes bookings for customers. Bookings we make are issued and ticketed through our third-party ticketing partners (such as consolidators, ticketing agencies, and other authorized issuers). In addition, some calls, messages, and requests may be handled by independent partner agencies acting on our behalf, as described in Section 7.
In addition to new bookings, we assist with itinerary changes, cancellations, refund requests, and general travel questions for trips booked through us, and β where reasonably possible β for trips booked elsewhere, subject to the airline's or supplier's own rules.
3. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding contract to use our Services, book travel through us, or submit a call-back request. By using the Services, you represent that you meet these requirements.
4. Fares, Pricing & Availability
Fares, rates, and prices displayed on our website β including on destination, hotel, and deal pages β are for illustrative and marketing purposes only. Displayed pricing generally reflects the lowest fare our systems found across a rolling twelve-month search window and does not represent a live, bookable quote.
Availability is not guaranteed at the time you call or submit a request, and fares can change without notice until a ticket is actually issued.
- A fare is not confirmed or guaranteed until it has been fully ticketed by our ticketing partner and payment has been processed.
- Wholesale, consolidator, and other discounted fares sometimes cannot be issued instantly. In some cases you may need to wait longer than a standard online booking to receive your confirmed tickets.
- Agent names shown anywhere on our website (for example, on live-chat-style displays) are illustrative; you will be connected to the next available qualified agent when you call.
5. Service Fees
As an independent travel marketplace and agency, we may charge a service fee in addition to the airline, hotel, or supplier's own fare or rate. Any applicable service fee will be disclosed to you by your agent before you agree to complete a booking, change, or cancellation. Service fees are generally non-refundable once a booking has been made, changed, or cancelled at your request, except where required by law.
6. Payment
Our website does not collect payment card information. Payment for bookings, changes, and service fees is handled directly with your agent over the phone at the time of booking, and may be processed by us or by our ticketing or payment partners. You are responsible for providing accurate billing information and ensuring you have authority to use the payment method provided.
7. How Calls, Messages & Requests Are Handled
Calls, messages, and requests generated through our website, advertisements, call-back requests, or contact channels may be handled in one of the following ways:
- Answered directly by our in-house team, who will assist you and make bookings on your behalf that are issued through our ticketing partners; or
- Routed to one of our independent partner agencies, who assist customers on our behalf; or
- Connected directly to an independent third-party provider β certain phone numbers and WhatsApp links published on our website connect you directly to independent partner agencies, and certain call-back or request forms are routed directly to those partners for handling.
Regardless of who answers, the service-fee disclosures and consumer protections described in these Terms apply to services provided by us and by partners acting on our behalf.
Independent partners. Partner agencies and third-party providers are independent businesses, not our employees or agents. They are located in various countries around the world β including, in many cases, India and other locations β and may be outside the United States and outside your country of residence. When you are connected to or dealing with such a partner, you are dealing directly with an independent foreign or domestic business.
We require our partners, by contract, to comply with applicable laws; to disclose that they are an independent business (including in their phone greeting or interactive voice response, on WhatsApp, on request forms, and whenever a customer asks who they are); to not impersonate or falsely claim to be any airline, any travel supplier, or to be us; and to obtain any authorization required to act on a customer's behalf. Partners may operate under a trade or desk name; what they may not do is claim or imply that they are an airline or misrepresent their identity when asked.
Because of the very high volume of calls and messages, we do not and cannot listen to or monitor every interaction. Our oversight is reasonable and sample-based: we may request and review random call recordings, we require the disclosures described above, and we investigate and act on complaints, including by requiring corrective action or terminating partners who violate our requirements. Except for bookings made and services performed by our own in-house team, we are not responsible for the independent acts, omissions, or misconduct of third-party providers. If you believe a provider has acted improperly, please report it to us at helpdesk@bargainairticket.com and we will address it.
8. Ticketing Partners
Bookings made through us are issued and ticketed through third-party ticketing partners, consolidators, and authorized issuers. Once a ticket is issued, the airline's or supplier's own contract of carriage, fare rules, and terms govern that ticket. We and our ticketing partners act as intermediaries in arranging the booking; the underlying transportation or service is provided by the airline, hotel, or supplier, not by us.
9. Authorization to Act on Your Behalf
When you ask us to help with a booking, change, cancellation, refund, or other travel request, you authorize and instruct us β and our partner agencies and ticketing partners acting on our behalf β to take the actions reasonably necessary to assist you. Specifically, you agree and consent that we and our partners may, on your behalf and with your permission:
- Contact and interact with airlines, hotels, car rental companies, cruise lines, rail operators, other travel suppliers, and other agencies, in order to research, arrange, book, change, cancel, or resolve issues with your travel;
- Collect, receive, access, and use details about your bookings and reservations (such as booking references, ticket numbers, itineraries, and fare information) and your personal information (such as your name, contact details, traveler details, and, where relevant to your trip, passport, visa, or identification information) for the purpose of assisting you with your request;
- Share the information described above with the relevant airlines, suppliers, ticketing partners, and partner agencies to the extent needed to carry out your request; and
- Communicate with those airlines, suppliers, and agencies about your booking as needed to provide the Services you have requested.
You confirm that you have no objection to us and our partners doing the above on your behalf, and that you are authorized to provide this permission (including where you are making arrangements for other travelers, for whom you confirm you have authority to act). This authorization is limited to carrying out the travel-related requests you make to us, and you may withdraw it at any time by contacting us at helpdesk@bargainairticket.com, though doing so may prevent us from completing a request already in progress. Nothing in this section requires us or any partner to take any action, and we and our partners will only act to the extent permitted by the applicable airline's or supplier's own rules and by law.
10. Affiliate Partners (Kayak)
We participate in Kayak's affiliate program. Where our website directs you to compare or book flights through Kayak, we may earn a commission if you complete a booking there. This does not affect the price you pay Kayak, and Kayak's own terms, privacy policy, and booking conditions govern any transaction you complete on their platform.
11. Cancellations, Changes & Refunds
Full details on cancelling or changing a booking, and on how refunds are processed, are set out in our Refund & Cancellation Policy, which is incorporated into these Terms by reference. Airline, hotel, and other supplier cancellation rules apply in addition to our own policy, and are typically the more restrictive of the two.
12. Call-Back Requests & Consent to Contact
If you submit a call-back request through our website (name, phone number, email, and an optional message), you authorize us β or a partner agency acting on our behalf, to whom your request may be routed directly β to contact you by phone, text message, and email regarding your request. Details on this consent, including how to opt out of future contact, are set out in our SMS/Calling Consent Terms.
13. Your Responsibilities
Before completing a purchase, it is your responsibility to:
- Review all trip details β dates, names, routing, and connections β for accuracy;
- Understand the fare rules, change/cancellation policy, and any restrictions that apply to your ticket before you pay;
- Ensure passport, visa, and other travel-document requirements are met for your itinerary; and
- Provide accurate contact and traveler information.
We are not responsible for losses arising from inaccurate information you provide, or from your decision to proceed with a booking without confirming fare rules you were given the opportunity to review.
14. No Airline or Supplier Affiliation
BargainAirTicket (Bookmecheapest LLC) is an independent travel marketplace and agency. We are not an airline, hotel, cruise line, rail operator, or car rental company, and we are not affiliated with, endorsed by, or acting as the representative of any airline or travel supplier referenced on our website. Airline and supplier names and logos are used solely to indicate that we can assist with ticketing or reservations for that provider.
15. Intellectual Property
All content on our website β including text, graphics, logos, and the BargainAirTicket name and branding β is owned by or licensed to Bookmecheapest LLC and is protected by applicable intellectual property laws. You may not copy, reproduce, or use our content or branding without our prior written permission.
16. Disclaimers & Limitation of Liability
Our Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the Services, including any warranty of accuracy, availability, or fitness for a particular purpose.
17. Indemnification
You agree to indemnify and hold Bookmecheapest LLC (BargainAirTicket) harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the Services, your violation of these Terms, or inaccurate information you provided in connection with a booking.
18. Third-Party Links & Services
Our website may link to or integrate with third-party services, including Kayak (fare comparison), WhatsApp (Meta Platforms, Inc.) for messaging, independent partner agencies, ticketing partners, and payment processors used during phone bookings. We are not responsible for the content, policies, or practices of these third parties. Your use of those services is governed by their own terms and privacy policies.
19. Privacy
Our collection and use of your personal information is described in our Privacy Policy and Cookie Policy, both of which are incorporated into these Terms by reference.
20. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles, except where the Federal Arbitration Act applies as described in Section 21 below.
21. Dispute Resolution & Binding Arbitration
Please read this section carefully. It affects your legal rights, including your right to go to court.
21.1 Agreement to Arbitrate
You and Bookmecheapest LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Services, or any booking made through us β except as expressly excluded below β will be resolved through binding, individual arbitration rather than in court, governed by the Federal Arbitration Act.
21.2 Class Action Waiver
You and Bookmecheapest LLC agree that any arbitration or claim will be conducted only on an individual basis and not as a class, collective, consolidated, or representative action. Neither you nor we may bring a claim as a plaintiff or class member in any purported class, collective, or representative proceeding.
21.3 Arbitration Procedure
Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Bookmecheapest LLC will pay any AAA filing fees in excess of what you would have paid to file a claim in small claims court. Arbitration will take place in Jacksonville, Florida, or, at your election, may be conducted by telephone or video conference, or based on written submissions only, for claims under $10,000.
21.4 Exceptions
Notwithstanding the above:
- Either party may bring an individual claim in small claims court, if it qualifies.
- As required by the federal Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act of 2021, claims alleging sexual assault or sexual harassment are not subject to this arbitration agreement and may be brought in court.
- Either party may seek injunctive relief in court to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.
21.5 Severability of This Section
If the class action waiver in Section 21.2 is found unenforceable for a particular claim, then that specific claim (and only that claim) may proceed in court, while the remainder of this arbitration agreement β including the requirement to arbitrate all other claims individually β remains in full force.
22. Severability
If any provision of these Terms (other than Section 21, which is governed by Section 21.5 above) is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
23. Changes to These Terms
We may update these Terms from time to time. Changes take effect once posted to this page with a revised "Last updated" date. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
24. Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, Refund & Cancellation Policy, and SMS/Calling Consent Terms, constitute the entire agreement between you and Bookmecheapest LLC regarding your use of the Services, and supersede any prior agreements on this subject.
